HOW CONSERVATION IS DONE

Modern conservation of land combines real estate planning,
preservation and environmental law, and sound tax advice. Each situation
requires different, sensitively planned and executed steps to ensure
the greatest financial and environmental advantage to the donor and
the Conservancy, tax, legal, and real estate advisors can provide the
land owner with help in every aspect of the process.
Although some property may be acquired in fee simple, we anticipate
most will be acquired by conservation easements. By this, the owner
agrees to place permanent restrictions on the use, clearing, or development
of some or all of the property. Options range from the stipulation
of development type or density to a prohibition of all construction.
The easement is a legal deed restriction which remains in force, usually
in perpetuity, without regard to who owns the land in the future. The
property may be sold or inherited as before, subject only to the restrictions
in the conservation easement. Such an easement has a value, as determined
by appraisal, and granting an easement to the Conservancy brings both
an income and real estate tax benefit and reduction in estate taxes.
